HIPAA PRIVACY, SECURITY, AND BREACH NOTIFICATION

The Trustees of the Welfare Fund, its employees, and all Business Associates providing services to the Fund, respect your right to the privacy of your health information. Since 2003, the Welfare Fund has followed a Privacy Policy which complies with federal laws and regulations under the Health Insurance Portability and Accountability Act ("HIPAA"), and subsequent regulations setting forth the HIPAA Privacy Rule, the Security Rule and the Breach Notification Rule, as amended under the Health Information Technology for Economic and Clinical Health ("HI-TECH") Act and the Genetic Information Nondiscrimination Act ("GINA").

These federal laws define the protections the Welfare Fund and its associates are required to follow in the use and security of individually identifiable health information they maintain or transmit concerning: an individual participant or dependent’s past, present or future physical or mental health or condition; the provision of health care to the individual; or, the past, present, or future payment for the provision of health care to the individual.

The Fund only uses Protected Health Information (“PHI”) in connection with day-to-day operational activities. It does not give or sell your information to parties who are not engaged in operational activities. The Fund has instituted measures to safeguard your protected health information, whether on paper files or electronically stored or transmitted.

The Welfare Fund will adhere to all of the privacy and security standards and rules issued by the relevant federal agencies. This includes the Fund’s encryption of e-mails containing PHI, as well as the monitoring of data flows and the remediation of discovered privacy or security breaches. The Fund will issue appropriate notices if there is an unauthorized acquisition, access, use or disclosure of PHI that compromises the security or privacy of an individual’s information. The Fund will cooperate with you in the investigation of, and response to a breach. A statement of the Fund’s privacy practices and your rights can be downloaded here. This statement will be mailed to you upon request.
